BlinkRemit Privacy Notice

This policy outlines how BlinkRemit collects, uses, and safeguards your personal information.

1. Introduction

Welcome to BlinkRemit Pty Ltd (“BlinkRemit,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your use of BlinkRemit’s money transfer services (“Services”). By accessing or using our Services—through our mobile application, in-person agent network, or any related channels—you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue using our Services.

These Terms should be read in conjunction with our Privacy Policy (“Agreement”). If any conflict arises between these Terms and the Privacy Policy, the specific language in these Terms will prevail for matters concerning the provision of our money transfer Services.

2. Eligibility and Registration

2.1 Minimum Age: You must be at least 18 years old and capable of entering a legally binding contract under Australian law to use our Services.

2.2 Accurate Information: You agree to provide true, complete, and up-to-date information when creating an account or initiating a transaction. If your personal details change, you will promptly update them to maintain accuracy.

2.3 Registration: We may require you to create an account, complete identity verification (e.g., via GreenID), and provide additional information to comply with anti-money laundering (“AML”) and counter-terrorism financing (“CTF”) obligations. We may decline to offer the Services if we cannot verify your identity or if you fail to meet any of our eligibility criteria.

3. Scope of Services

BlinkRemit offers international money transfer Services for sender-side customers in Australia. Once you submit a transfer (“Transaction”), we will forward your funds (plus any applicable fees) to a designated recipient (“Beneficiary”) using our payout partners, such as Bakaal, or other authorized agents in the destination country. The availability of transfer destinations and methods may vary based on local regulatory requirements or business considerations.

We may add, change, or discontinue any portion of the Services at any time. We will endeavor to give prior notice, where practicable, if such changes materially affect your existing Transactions.

4. In-Person Agent Transactions

If you conduct a Transaction through our in-person agents, you agree that:

  • Data Collection: The agent will collect information (such as your ID details and transaction specifics) and transmit it securely to BlinkRemit’s central system. Agents are contractually bound to protect your data per our Privacy Policy and Australian law.
  • Verification: You may be required to show government-issued ID or additional documentation to comply with AML/CTF regulations. The agent may refuse to proceed if your details are incomplete or unverifiable.
  • Receipt and Confirmation: Always check the Transaction details (amount, recipient name, fees) before confirming payment. Retain any receipt or reference number provided by the agent for future inquiries.

5. Fees, Currency Conversion, and Payment

5.1 Fees and Charges: We will disclose applicable fees prior to your final confirmation of a Transaction. By completing the Transaction, you authorize BlinkRemit (or its payment processors) to debit your chosen funding method for the principal transfer amount plus fees. If an intermediary bank or the Beneficiary’s bank imposes charges, those are beyond our control.

5.2 Currency Conversion: If you request a currency conversion, we will disclose the applicable exchange rate before completing the Transaction. Exchange rates may fluctuate, and we are not liable for any losses due to exchange rate volatility.

5.3 Payment Methods: We may accept bank transfers, card payments, or other methods. Some methods may carry additional charges imposed by third parties. You bear responsibility for all third-party charges (e.g., credit card fees).

6. Compliance with Laws

6.1 AML/CTF Obligations: We comply with Australian and international AML/CTF laws. We may require additional documentation from you or temporarily hold or cancel a Transaction if we suspect it violates compliance requirements.

6.2 Sanctions Checks: We reserve the right to screen recipients or transactions against applicable sanctions lists. If a match or potential match arises, we may suspend or terminate the Transaction and report to relevant authorities where required.

6.3 Accurate Information: You warrant that all information provided about yourself and the Beneficiary is true and accurate. You confirm that you have obtained the Beneficiary’s consent, where necessary, to share their details for the purpose of effectuating the Transaction.

7. Transaction Timing and Delivery

We aim to deliver funds to the Beneficiary promptly, subject to local banking hours, regulatory approvals, and any additional checks. We do not guarantee a specific delivery timeframe. Delays may occur due to weekends, holidays, bank processing times, unforeseen technical issues, or incomplete beneficiary information.

If the Beneficiary fails to collect the funds or if the transaction cannot be completed within a specified timeframe, we may cancel the Transaction and refund the principal amount (minus applicable fees) according to our refund policies.

8. Refunds and Cancellations

8.1 Cancellation by Sender: You may request to cancel a Transaction before payment has been released to the Beneficiary. We will attempt to accommodate cancellations at our discretion, and any refund is subject to whether funds have already been disbursed. Certain fees may be non-refundable.

8.2 Cancellation by BlinkRemit: We may cancel or delay a Transaction if we suspect fraud, AML/CTF concerns, or regulatory non-compliance. We will notify you if this occurs (unless legally restricted from doing so).

8.3 Method of Refund: If a refund is approved, it will typically be returned through the same method used to fund the Transaction unless mutually agreed otherwise or required by law.

9. Warranties and Disclaimers

9.1 “As Is” Basis: We strive to provide reliable Services, but to the maximum extent permitted by law, we disclaim all warranties—express, implied, or statutory—regarding performance, suitability, or continuity of the Services.

9.2 Third-Party Payouts: We partner with banks and payout agents (e.g., Bakaal) to deliver funds. We do not guarantee their performance or speed in crediting the recipient’s account. Once we have submitted the Transaction to a partner, we rely on them to handle the final payout.

9.3 No Advice: Any exchange rates, marketing material, or statements provided by us do not constitute financial or legal advice. You are responsible for assessing whether a Transaction meets your needs.

10. Limitation of Liability

10.1 Extent of Liability: Except where prohibited by law, BlinkRemit’s total liability in connection with any Transaction is limited to the sum of the principal transfer amount plus fees paid for that specific Transaction. We are not liable for indirect, consequential, or incidental damages (e.g., lost profits, delayed opportunities) related to use of the Services.

10.2 Contributory Fault: We have no liability for losses arising from incorrect details provided by you (e.g., wrong Beneficiary account), fraudulent activity you facilitate, or your failure to comply with these Terms.

10.3 Non-excludable Guarantees: Nothing in these Terms excludes, restricts, or modifies any consumer guarantees or statutory rights under Australian Consumer Law that cannot be lawfully excluded. Where such laws apply, our liability is limited to the remedies provided therein.

11. Customer Obligations and Account Security

You are responsible for maintaining the confidentiality of your account credentials. Any unauthorized use of your account must be reported to us immediately. We are not liable for losses arising from the unauthorized use of your account if you have not taken reasonable steps to protect your credentials.

12. Termination

12.1 By BlinkRemit: We may suspend, restrict, or terminate your access to the Services at any time if we suspect fraudulent activity, breach of these Terms, or other violations of law. We will notify you unless we are legally prohibited from doing so.

12.2 By You: You may stop using our Services at any time. However, any pending Transactions must still be completed or canceled if permissible. Termination does not eliminate obligations incurred before the date of termination, such as fees owed.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of New South Wales, Australia, without regard to its conflict-of-law provisions. Any disputes arising from or related to these Terms or the Services will be heard exclusively in the courts of New South Wales. We encourage you to contact us first to attempt an amicable resolution.

14. Changes to These Terms

We may revise or update these Terms from time to time. Any material changes will be posted on our website or communicated via other appropriate channels. Your continued use of the Services after the changes become effective constitutes your acceptance of the updated Terms.
